P4 AUTOMATED PARKING
PARKING REGULATION AND GENERAL TERMS AND CONDITIONS
1. These general terms and conditions of contract, prepared as an offer to the public, regulate the contractual relationship of a private nature between the users and the operator of the car park service (Hotel Lago di Braies Srl), providing that with the access of the vehicle to the car park, the customer enters into a contract for the use of the car park and accepts these regulations in full, in accordance with the tariffs in force and these general conditions of use, without the obligation of supervision and custody by Hotel Lago di Braies Srl. The collection of the ticket is necessary in any case, even in the event that, due to faults or other events, the automated gate should be open.
2. Any customer who, after having brought their vehicle into the car park, does not wish to accept the conditions of these regulations, may leave the area within 15 (fifteen) minutes of entering, at no cost to him/her, by inserting at the exit column the ticket collected at the entrance.
3. The parking ticket allows the vehicle to park in free parking spaces, excluding reserved parking spaces. It is prohibited to park in front of emergency exits, pedestrian entrances and exits, in drive-through lanes and reserved spaces, in which case the operator reserves the right to remove the vehicle, charging the relevant costs and applying a penalty of € 100.00, subject, in any case, to the right to compensation for greater damages. In the event of ticket loss, a new ticket will be provided, subject to payment of a fee of € 50.00.
4. Payment must be made before the vehicle leaves the car park by going to the automatic cash machines, which will issue a ticket to be used to exit the vehicle from the parking area. The vehicle must be exited within 15 (fifteen) minutes from the payment of the amount due, after which, if the vehicle is still in the area, the Customer shall supplement the payment at the cash desk, in accordance with the rates in force. Leaving the car park by queuing with another car without inserting the validated ticket in the automated exit device (before the gate) shall result in the payment of a penalty of € 200.00, subject to compensation for any damage caused to the automated device and general expenses.
5. The request for a copy of the receipt - the automated cash desks issue a copy of the receipt, which the user can request by pressing the receipt button at the time of payment.
6. The amount owed by the parking customer results from the calculation of the parking time based on the rates in force. These rates, applied in the car park, are displayed in the parking area, and are understood to be known and accepted by the customer who has entered and parked a vehicle in the car park.
7. Hotel Lago di Braies provides Customers exclusively with delimited spaces dedicated to the parking of vehicles and does not assume any obligation of surveillance or custody of the vehicle, its accessories, luggage, valuables and other objects contained therein. Hotel Lago di Braies is not responsible for direct and/or indirect damage suffered by the vehicle, for whatever cause, nor for the theft of the vehicle, even partial, consumed or vehicle, even partial, consumed or attempted, and/or its accessories or luggage, valuables and other objects left in the vehicle. Hotel Lago di Braies is also not responsible for any damage caused to parked vehicles by other users or vehicles present in the area, nor for any damage to vehicles parked in the area, damage caused by acts of vandalism, civil unrest, demonstrations and acts of terrorism, or resulting from natural disasters or force majeure. It is forbidden to abandon vehicles in a bad condition; in this case the costs of removal will be charged in full to the owner of the vehicle.
8. Within the parking area, the customer must comply with the rules of the Highway Code (Codice stradale), as well as with the written and verbal instructions or signs provided by the car park staff. Failure to comply with these regulations will result in the exclusive personal liability of the defaulting customer in relation to any damage caused to his own or another's vehicle, persons or property.
9. The P3 car park provides 8 free parking spaces for people with a disabled person's badge. Vehicles displaying the badge in a visible place, may park free of charge only and exclusively in the 8 (eight) reserved spaces. The disabled person who leaves his car in spaces not designated for disabled persons will be subject to payment of the amount resulting from the calculation of the parking time on the basis of the rates in force, despite the presence, on the dashboard of the car, of the disabled driver's badge.
10. Pursuant to EU Regulation 2016/679, the processing of information concerning Customers will be based on the principles of correctness, lawfulness, transparency and protection of confidentiality.
11. The area is subject to video surveillance for security reasons.
12. The court of jurisdiction for any and all disputes concerning the interpretation and/or implementation of these Regulations shall be exclusively that of Bolzano.
